Terms of Service

1. Services

By Callan provides digital marketing strategy, SEO, paid advertising management, workflow automation, web design, and site audit services. Services are delivered by Robert Callan on a month-to-month basis unless otherwise agreed in writing. The scope, deliverables, and timeline for each engagement are defined during the onboarding process.

2. Free Website Scan

The free website scan available at bycallan.com/audit is provided as-is for informational purposes. Scan results are automated and may not capture every issue. The scan does not constitute professional advice or a guarantee of findings.

3. Site Audit ($97)

The full site health audit is a one-time purchase of $97 processed through Stripe. The audit report is delivered via email within 24 hours and includes a 30-minute walkthrough call. Refunds are available within 7 days if you are unsatisfied with the report.

4. Retainer Engagements

Monthly retainers are billed at the beginning of each month. All retainers are month-to-month with no long-term contracts. Either party may terminate with 30 days written notice.

Work hours and deliverables are defined in the scope of each engagement. Hours do not roll over between months unless explicitly agreed.

5. Payment

Payments are processed securely through Stripe. By Callan does not store credit card information. Invoices for retainer engagements are due upon receipt. Late payments may result in a pause of services until the balance is resolved.

6. Intellectual Property

All work product created during an engagement (copy, designs, automations, reports) is owned by the client upon full payment. By Callan retains the right to use anonymized results and general methodologies in portfolio materials unless otherwise agreed.

Third-party tools and platforms (Google Ads, HubSpot, n8n, etc.) remain subject to their own terms of service and licensing.

7. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the engagement, including business data, analytics, strategies, and financial information. This obligation survives termination of the engagement.

8. Limitation of Liability

By Callan provides marketing services on a best-effort basis. We do not guarantee specific results such as search rankings, traffic volumes, or revenue increases. Marketing outcomes depend on many factors beyond our control. Our total liability is limited to the fees paid for the specific service in question.

9. Use of This Website

You agree not to misuse this website, including but not limited to: submitting false information through forms, attempting to disrupt or overload the site, scraping content without permission, or using the free scan tool to harass or target other websites.

10. Governing Law

These terms are governed by the laws of the State of Illinois, United States. Any disputes arising from these terms or from services provided will be resolved in the courts of Cook County, Illinois.

11. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the updated terms.
